1. Eligibility

Parents and guardians who create accounts to generate content for children under 13 are responsible for monitoring and supervising their child's use of any materials created through our Service.

2. Account Registration and Security

To access certain features of our Service, you may need to create an account. When creating an account, you must provide accurate and complete information. You are responsible for:

• Maintaining the confidentiality of your account credentials and password
• All activities that occur under your account
• Notifying us immediately of any unauthorized access or use of your account
• Ensuring that your account information remains accurate and up-to-date

We reserve the right to suspend or terminate accounts that violate these Terms or are inactive for extended periods.

3. Credit Packs and Billing

3.1 Credit Pack Structure

LoveToRead.AI operates on a credit-based system. Credits are used to generate stories and can be purchased through the following packs:

• Storyteller Pack: $9.99 for 100 credits (~14 average stories)
• Dreamer Pack: $19.99 for 225 credits (~32 average stories)
• Creator Pack: $49.99 for 650 credits (~93 average stories)

Free trial users receive limited credits to test the Service before purchasing.

3.2 Payment and Purchase

When you purchase a credit pack:

• Payment is processed immediately upon purchase
• Credits are added to your account and do not expire
• Credits are consumed each time you generate a story
• You can purchase additional credit packs at any time

3.3 Refund Policy

All credit pack purchases are non-refundable once credits have been added to your account. If you have not used any credits from a purchase, you may request a refund within 48 hours by contacting our support team at support@lovetoread.ai.

Exceptions may be made at our sole discretion in cases of technical errors, billing mistakes, or other extraordinary circumstances.

3.4 Price Changes

We reserve the right to modify credit pack prices at any time. Price changes will not affect credits already purchased and in your account. We will provide reasonable notice of any price changes through the Service or via email.

4. Service Features and Limitations

4.1 Story Generation

Our Service uses artificial intelligence to generate personalized storybooks based on your input. While we strive to create high-quality, age-appropriate content:

• Generated content may vary in quality and may not always meet your expectations
• We do not guarantee that every generated story will be perfect or error-free
• You may regenerate stories as needed within your available credits
• Story generation times may vary based on complexity and system load

4.2 Content Filtering and Safety

Our AI is trained to generate age-appropriate content and includes safety filters to prevent inappropriate material. However, we cannot guarantee that all generated content will be completely free from unexpected or undesired elements. Parents, guardians, and educators should review generated content before sharing it with children.

4.3 Credit Usage

Credits are consumed based on:

• Story length and complexity
• Number of illustrations generated
• Customization options selected

The average story uses approximately 7 credits, but this may vary. Credit costs are displayed before you generate each story.

5. Intellectual Property Rights and Commercial Use License

5.1 Our Content

All content included in the Service, including but not limited to the website design, graphics, logos, software, and the Service itself, is the property of LoveToRead.AI or its content suppliers and is protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any content on our Service without our express written permission.

5.2 Your Rights to Generated Stories

This is important: Your rights to use, distribute, and sell stories you generate depend on whether you are using free trial credits or have purchased a credit pack.

5.3 Free Trial Users - Personal Use Only

If you generate stories using free trial credits:

• You may use the stories for personal, non-commercial purposes only
• You may share the stories with family and friends
• You may NOT sell, distribute publicly, or use the stories for any commercial purpose
• You may NOT publish the stories in any format (print, digital, online) for commercial purposes

5.4 Paid Credit Pack Users - Full Commercial License

When you purchase ANY credit pack (Storyteller, Dreamer, or Creator Pack), you receive full commercial rights to all stories generated with those purchased credits.

This means you can:

• Sell your books: Publish and sell physical or digital copies of your generated stories on any platform (Amazon KDP, Etsy, your own website, etc.)
• Distribute freely: Share, give away, or distribute your stories in any manner you choose
• Modify and adapt: Edit, modify, or create derivative works from your generated stories
• Use commercially: Use your stories for any commercial purpose including merchandise, educational materials, or promotional content
• Retain copyright: You own the copyright to the specific stories you generate

No additional licenses or fees are required. Once you purchase a credit pack, every story you create with those credits is yours to use however you wish, including for commercial sale and distribution.

5.5 User-Provided Content

By submitting content to our Service (such as story prompts, character descriptions, or feedback), you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display that content solely for the purpose of providing and improving the Service. We will never sell your personal story ideas or prompts to third parties.

6. Acceptable Use Policy

You agree not to use our Service in any way that:

• Is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Violates the rights of others, including but not limited to privacy, publicity, and intellectual property rights
• Attempts to generate inappropriate, harmful, or illegal content involving minors
• Interferes with the proper functioning of our Service, including uploading viruses, malware, or other harmful code
• Attempts to gain unauthorized access to our systems, servers, or data
• Uses automated systems, bots, or scripts to access the Service without authorization
• Impersonates any person or entity or misrepresents your affiliation with any person or entity
• Attempts to reverse engineer, decompile, or extract the source code of our AI models or Service

We reserve the right to investigate and take appropriate legal action against anyone who violates this Acceptable Use Policy.

7. Educational Use and Classroom Licenses

Teachers and educational institutions using our Service for classroom purposes must ensure that:

• They have appropriate permissions and consents to create content for their students
• Student privacy is protected in accordance with applicable laws (such as FERPA and COPPA)
• Generated content is reviewed before sharing with students
• The Service is used in accordance with their institution's acceptable use policies

We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party services. You acknowledge and agree that we shall not be responsible or liable for any damage or loss caused by your use of any third-party services.

Payment processing is handled by third-party payment processors. By using our Service, you agree to be bound by the terms and conditions of these payment processors.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LOVETOREAD.AI, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of (or inability to access or use) the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your content or account

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

Nothing in these Terms shall exclude or limit our liability for:

• Death or personal injury caused by our negligence
• Fraud or fraudulent misrepresentation
• Any liability which cannot be excluded or limited under applicable law

11. Indemnification

You agree to indemnify, defend, and hold harmless LoveToRead.AI, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Any content you submit, post, or transmit through the Service
• Your commercial use of generated stories (subject to the license granted)

12. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice, for any reason including but not limited to:

• Violation of these Terms
• Fraudulent, abusive, or illegal activity
• Extended periods of inactivity
• Requests by law enforcement or government agencies

Upon termination:

• Your right to use the Service will immediately cease
• We may delete your account and any unused credits
• You will not be entitled to any refund of fees paid
• You retain all commercial rights to stories previously generated with purchased credits
• Stories generated with free trial credits revert to personal use only

13. Modifications to the Service and Terms

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

We may update these Terms from time to time to reflect changes in our practices, legal requirements, or for other reasons. We will notify you of any material changes by:

• Posting the new Terms on our website with an updated "Last updated" date
• Sending an email notification to the address associated with your account
• Displaying a prominent notice on the Service

We shall not be liable for any failure or delay in performance of our obligations under these Terms due to causes beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, or government actions.
